Life Of David Gale Makes No Sense!!!!!!?

In the movie kevin spacey asks kate winselet to investigate to prove him innocent so that his son wont think badly of him because he knows he is going to die. So what was the point of him asking her to investigate if the tape was going to be released anyway to show that he had NOT murdered that woman???? Somebody please explain to me. Great movie by the way.
